The Resignation of USPTO Commissioner Vaishali Udupa: What It Means for the Patent Office and Patent Owners

Less than two months ago Coke Morgan Stewart took over from Kathi Vidal as Acting Director of the United States Patent and Trademark Office (USPTO). Now the Commissioner for Patents, Vaishali Udupa, has resigned from the USPTO after only two years in office. Although her resignation was listed on the USPTO website, news of her registration apparently was not initially relayed to rank and file patent examiners at the USPTO. Her resignation comes amid significant political and structural changes within the federal government, including a buyout program initiated by President Donald J. Trump to encourage federal employees to transition into the private sector?.

The Role and Challenges of the Commissioner for Patents

Tasked with managing over 9,000 patent examiners, the role of Commissioner for Patents has historically been held by USPTO employees who rose through the ranks. Bucking that convention, Vaishali Udupa was a private sector intellectual property prosecutor, litigator, and strategist.

Despite her experience in the private sector, Udupa was unable to control the increasing backlog of patent applications at the USPTO under her watch, something that drew the ire of policymakers looking to improve the efficiency of the patent examination process?. Udupa’s heavy focus on diversity and equity in the IP space, as applications piled up at the USPTO, may have contributed to political pressure surrounding her role of Commissioner as well as her sudden departure?.

The Political and Structural Context Behind Udupa’s Resignation

Udupa’s departure aligns with the Trump administration’s broader initiative to downsize the federal workforce by offering federal employees an eight-month severance package if they resign voluntarily?. In addition to concerns about her performance amid the rising backlog of patents at the USPTO, ?Udupa’s close relationship with recently resigned USPTO Director Kathi Vidal may also have influenced her decision to resign. 

What’s Next for the USPTO?

With Udupa’s departure, Deputy Commissioner Valencia Martin Wallace has stepped in as Acting Commissioner?. However, with Howard Lutnick slated to become the next Secretary of Commerce and his avowed commitment to reduce the growing patent application backlog at the USPTO, unless Commissioner Wallace can begin reducing the patent backlog at the USPTO immediately, she may not be long for the job.
